Please read this carefully. This Risk Acknowledgement, Participant Declaration and Liability Waiver applies to every person joining a Mumbai Trekizens trek, camp, river-rafting, rappelling, climbing, wildlife or adventure activity ("Activity"). By booking and by accepting this document, you confirm you have read, understood and agreed to it. This complements our Terms & Conditions.

1. Acknowledgement of Risk

I understand that adventure activities are inherently dangerous and involve real risks including, but not limited to: slips, trips and falls; uneven, slippery or steep terrain; falling rocks; fast-moving or deep water; heights; extreme or changing weather; high altitude; wildlife, insects and plants; remote locations with limited or delayed medical help; and risk of injury, illness, disability or death. I voluntarily choose to participate with full knowledge of these risks.

2. Fitness & Health Declaration

  • I confirm I am medically and physically fit for the Activity I have chosen.
  • I have disclosed any pre-existing medical condition (including asthma, heart condition, high/low blood pressure, diabetes, epilepsy, recent surgery, or pregnancy) at the time of booking.
  • I have consulted a doctor where appropriate, and I carry any personal/prescription medication I need.
  • The emergency contact and health details I provide are accurate and may be used in an emergency.

3. Assumption of Responsibility

I accept that I participate at my own risk and of my own free will. I will follow all safety instructions and decisions of the trek leader, use provided safety equipment correctly, stay with the group and on the designated route, and not attempt anything beyond my ability.

4. Release & Waiver of Liability

To the maximum extent permitted by law, I release and hold harmless Mumbai Trekizens, its owners, employees, trek leaders, volunteers, contractors and partners ("the Organisers") from any claim, liability, loss, damage, cost or expense arising out of my participation in the Activity — including personal injury, illness, disability, death, or loss of or damage to property — except where caused by the Organisers' gross negligence or wilful misconduct as proven in a court of law. Nothing in this waiver excludes any liability that cannot be excluded under Indian law.

5. Medical Treatment Consent

In an emergency where I cannot consent, I authorise the Organisers to arrange first aid and/or emergency medical treatment and transport on my behalf. I accept responsibility for the associated costs.

6. Conduct & Removal

I will behave responsibly, will not consume alcohol or drugs before or during the Activity, and will respect fellow participants, staff, local communities and the environment (leave no trace, no single-use plastic). I understand the Organisers may remove me from the Activity, without refund, for unsafe conduct or non-compliance, and may refuse participation if I appear unfit at the reporting point.

7. Media Consent

I grant the Organisers the right to use photographs and videos taken during the Activity (in which I may appear) for their marketing, unless I inform them in writing before the Activity.

8. For Minors

Where a participant is under 18, this declaration and waiver must be accepted by a parent or legal guardian, who accepts these terms on the minor's behalf and confirms the minor's fitness to participate.

9. Governing Law

This waiver is governed by the laws of India, subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

10. Declaration

By booking and accepting this document (online at the time of booking, or by signature at the event), I confirm that I have read and understood this Risk & Liability Waiver, that all information I have given is true, and that I agree to be bound by it.
